Andrea Picco is an associate in LashGoldberg’s Fort Lauderdale office. Her practice focuses on complex business litigation, health care litigation and internal investigations.  She has represented clients in high-stakes commercial disputes in federal, state and international jurisdictions, arbitration, as well as in enforcement proceedings by the Department of Justice and Securities and Exchange Commission regarding the False Claims Act and Foreign Corrupt Practices Act.  Prior to joining the firm, Andrea was an associate at an AM Law 200 global litigation firm in Miami.

Andrea is a graduate of University of Florida Levin School of Law, magna cum laude, where she was Executive Outreach Chair on the Journal of Law & Public Policy.  Andrea received her undergraduate degree, magna cum laude, from the University of Florida.

Representative Matters

• Member of team that advised and represented multistate nonprofit healthcare system with 12 hospitals and 27K+ employees in 5 actions alleging state and federal whistleblower violations. Prevailed on motions to dismiss and summary judgment.

• Member of team that advised and represented global medical device manufacturer to resolve allegations that it violated the False Claims Act by causing the submission of false claims to Medicare and Medicaid by inducing physicians with kickbacks.

• Member of team that represented global firm providing audit, tax, and advisory services in response to SEC subpoenas, ensuring compliance with all requests and managing the legal implications of investigations.

• Member of team that conducted internal investigation on behalf of the Special Committee of the Board of Directors of global franchisor into certain allegations of misconduct raised in public reports and subpoenas issued to the company as well as other potential accounting and disclosure issues in connection with company’s filings.  

• Conducted internal investigation with partner on behalf of Special Committee of the Board of Directors of food distributor that voluntarily disclosed to the SEC and DOJ possible FCPA violations in Mexico.

• Developed an internal investigation strategy with partner and senior counsel for guacamole manufacturer in Mexico, conducted in-person and virtual investigation interviews. Delivered investigation findings to CEO and General Counsel. Developed and held trainings on compliance and best practices.

• Conducted internal investigation with partner for Mexican car battery manufacturer facing allegations of Foreign Corrupt Practices Act violations, conducted in-person and virtual investigation interviews, and worked together with compliance teams to enhance corporate governance practices to litigate legal risks.

• Represented a target witness with partner in a related Foreign Corrupt Practices Act investigation and civil litigation. Also advised alongside local counsel in related Mexican criminal case. Prepared and represented target witness throughout multiple government interviews, civil depositions, and trial testimony.  

• Member of team that conducted investigation into potential allegations of fraud, corruption, and compliance violations of a Nicaraguan cigar manufacturer. Delivered investigation findings to CEO and General Counsel. Facilitated training sessions on compliance and best practices to prevent Foreign Corrupt Practices Act violations.

• Represented satellite designer and manufacturer with two partners in a multimillion-dollar breach of contract action, prevailing on motion for summary judgment.  

• Member of team which prevailed on all claims at federal district, state trial, and state appellate levels in representation of global insurance broker in $20M contract and tort actions. Prevented litigation by securing multiple dismissals in Puerto Rico and Illinois and prevailed on appeal.

• Member of team that negotiated favorable settlement for international insurer in $15M fraud and FDUTPA action involving an $80M construction project in South America.

• Negotiated favorable settlement with partner for mortgage companies in breach of contract claims involving a $3M loan.  

• Negotiated favorable settlement with two partners for health, beauty, and wellness company in multiple breach of contract disputes involving celebrity endorsers.
