Hospital Chain and Debt Collector Absolved of Original Claims in Class Action Settlement
After more than five years of protracted litigation, Lash & Goldberg LLP favorably resolved a national consumer class action against a national health system and an affiliate in federal court. The complaint asserted that the defendants had engaged in a pattern and practice of unlawfully “balance billing” class member-patients in violation of state and federal consumer protection laws.
After extensive discovery established that all of the class claims against the health system lacked merit, the health system moved for final summary judgment and opposed plaintiffs’ class certification motion. The parties thereafter settled the matter, and all of the class claims against the health system were dismissed with prejudice and released.
