Hospital Obtains Dismissal with Prejudice of Former Employee’s False Claims Act Case
Lash & Goldberg LLP represented a not-for-profit hospital in defense of a qui tam action brought by a former employee pursuant to 31 U.S.C. § 3730(b) of the False Claims Act. The former employee alleged that the hospital purportedly filed certain false claims with the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services. Following extensive discovery including the plaintiff’s deposition, the case was dismissed with prejudice with no monetary or other relief provided to the relator or the government.
