Physician Services Company Defeats $2 Million Breach of Employment Contract Claim
Lash & Goldberg LLP defended a physician services company in arbitration before a retired state trial and appellate court judge against a physician’s $2 million breach of contract claim. The company had terminated the physician’s employment agreement on the grounds that he had breached his representations and warranties regarding the existence of a restrictive covenant with his former employer. The physician claimed that the physician services company’s termination was wrongful because the non-compete provision in his prior employment agreement was unenforceable. Following a lengthy final arbitration hearing, the physician services company obtained a final award in its favor on all claims, resulting in the complete dismissal of the physician’s arbitration demand.
